According to a recent News4Jax news article, a lawsuit is being filed against Wal-Mart, and the trucking company Swift, for the death of Wiley Clark. Clark, of Jacksonville, Florida was a retired investigator from the Bradford County State Attorney’s office.
Clark never returned home after going out to breakfast one Sunday morning. A Swift tractor-trailer travelling over the speed limit crossed the median and crashed into Clark’s vehicle head on, leaving him dead at the scene, the news report stated.
Wiley Clark’s widow is suing Wal-Mart, as well as Swift, the trucking company that Wal-Mart is associated with for the wrongful death of her husband. Lawyers acting for the family in the wrongful death case claim the 18-wheeler was going 17 miles over the speed limit and its tires were worn down to 1/32nd of an inch, which is in violation of federal standards. They say they have driver logs that point to the truck driver being overworked.
Mr. Clark’s widow believes these factors are the cause of the accident, and if it weren’t for them then her husband would still be alive today.
